At Top Inka Travel, we are committed to providing unforgettable travel experiences while complying with current legal regulations in Peru. Before making a reservation, we recommend that you carefully read our Terms and Conditions of Use, as confirming your request implies full acceptance of these terms.

By booking any tour or service with us, you enter into a contract governed by Peruvian law and subject to the exclusive jurisdiction of Peruvian courts. The booking must be made by a person over the age of 18 and is binding for all travelers included in the request, including minors and individuals with special needs.

We also guarantee the security and privacy of your personal information, complying with protection standards to create a trustworthy environment for your trip.

Our terms include relevant information regarding payment policies, cancellations, refunds, and health and safety requirements. If you have any questions, our customer service team is available to provide personalized assistance.

RESERVATION POLICIES


Our goal is to offer you a well-organized and safe travel experience from the very first contact. That’s why we have established an efficient reservation process that guarantees your participation in the selected tour programs.

1: HOW TO MAKE A RESERVATION

All reservations must be processed through our online form on the official website or by sending an email to: reservas@topinkatravel.com. You can also contact us directly via WhatsApp at +51 948 287 034.

Reservations must be made at least 48 hours before the service begins and up to 12 months in advance, depending on availability.

For urgent inquiries or personalized assistance, you can call or message us during business hours: 9:00 a.m. to 8:00 p.m. (Peru time).

2: PAYMENT METHODS

To confirm your reservation, we offer secure and verified payment methods:

  • Credit or Debit Card We will send you a personalized payment link. A 6% processing fee will be added and must be covered by the passenger.
  • Western Union – International Transfer You can send the payment to one of the following people (choose one):
  • Leydy Abril Andrade Bengolea – DNI: 73514176
  • Jheison Huamanhuillca Pillco – DNI: 73955684

Mode: Cash Pickup – Peru
You must send us the MTCN code to confirm the transfer.

  • National Bank Transfer Available exclusively for Peruvian citizens. Bank details will be provided once the payment is coordinated.
  • Cash Payment (Only for Remaining Balance) You can pay directly at our main office only if you are in Cusco – Calle Nueva Alta 495.

3: PAYMENT CONDITIONS BASED ON SELECTED SERVICES

  • Tours without hotel: An advance payment of 60% of the total amount is required to confirm the reservation. The remaining 40% must be paid no later than 48 hours before the first tour begins.
  • Packages with hotel: A minimum advance of 50% is required to confirm. The final balance must be paid on the first day of arrival, before the first tour.

Important: If the payment deadlines are not met, the passenger will not be able to access the booked services and will lose the right to any claim or refund.

4: REQUIRED INFORMATION TO PROCESS A RESERVATION

To correctly validate and confirm your reservation, please send the following information for each traveler:

  • Full name (as it appears on passport or ID)
  • Passport or ID number
  • Nationality
  • Date of birth
  • Start and end dates of the tour
  • Chosen payment method

Important: All provided information must be accurate. Top Inka Travel is not responsible for errors or omissions, as this data will be used to issue tickets, entry permits, and other logistics.

If you prefer, you can send a clear photo of your passport or ID to reservas@topinkatravel.com or via WhatsApp at +51 948 287 034, and there is no need to fill out the form.

Once the information is received and availability is confirmed, you will receive a unique reservation code along with the itinerary details.

CANCELLATION POLICIES

1: CANCELLATIONS REQUESTED BY THE PASSENGER

All cancellation requests must be submitted in writing to reservas@topinkatravel.com or via WhatsApp at +51 948 287 034. The date of receipt will be used to apply the corresponding penalties.

TOUR PACKAGES OF 2 DAYS OR MORE INCLUDING MACHU PICCHU

  • Up to 90 days before the trip: 15% penalty of total value
  • Up to 60 days before the trip: 50% penalty
  • Up to 30 days before the trip: 70% penalty
  • Less than 30 days: 100% penalty (non-refundable)

FULL DAY TOURS

  • Up to 60 days before: 10% penalty
  • Up to 30 days before: 20% penalty
  • Up to 7 days before: 60% penalty
  • Less than 48 hours or no-show: 100% penalty

MACHU PICCHU FULL DAY TOUR

  • Up to 60 days before: 30% penalty
  • Up to 30 days before: 50% penalty
  • Up to 20 days before: 70% penalty
  • Less than 20 days: No refund

GENERAL CONSIDERATIONS

  • All bank fees, international transfer charges, or card processing fees will be borne by the passenger.
  • In group bookings, individual cancellations will be reviewed on a case-by-case basis.
  • Promotions, special offers, or discounted packages are non-refundable.
  • The client is responsible for entering correct personal information. Any service issues caused by errors will be the client’s responsibility.
  • For verification, a photo of the passport or ID can be sent to our email or WhatsApp.

2: CANCELLATIONS BY TOP INKA TRAVEL

Top Inka Travel is committed to providing services as per the agreed itinerary. However, we reserve the right to modify or cancel any part of the package due to unforeseen force majeure circumstances, including strikes, riots, landslides, train delays, adverse weather, social unrest, or government decisions. In such cases, we will offer equal-value alternatives but will not issue refunds.

If itinerary changes are needed due to such events, we will notify the client as soon as possible and present alternative options. Any additional costs from these changes must be covered by the client.

PACKAGES WITH MACHUPICCHU

For those who have contracted packages that include Machu Picchu, if they are in Cusco and external situations such as weather conditions, strikes, social mobilizations, landslides, among others, will not be able to proceed with refunds, since these events do not depend on the responsibility of Top Inka Travel. In these cases, clients will lose the contracted activity without the right to reimbursement.

At TOP INKA TRAVEL we understand that unforeseen events may arise that alter travel plans. Therefore, we have a clear and fair cancellation policy, designed to protect both our passengers and the operation of our services.

IMPORTANT INFORMATION

Top Inka Travel is not responsible for the consequences derived from tour delays or train delays due to situations beyond the company’s control. This includes the possible loss of national or international flights, which will be assumed by the passenger. Top Inka Travel does not include packages with air flights, so any affectation to the flights will be the sole responsibility of the client.

The corresponding refunds will be processed within 30 working days from the approved request. It is important to note that bank transfer fees, international wire transfer commissions or any other additional charges related to the refund will be assumed by the passenger.

MODIFICATION AND RESCHEDULING POLICIES

Top Inka Travel offers carefully designed travel packages with reservations for hotels, trains, entrance fees, essential services, etc. It is important to note that once the advance or full payment of the package has been made, the details of the package cannot be changed under any circumstances, as the reservations and associated services are not transferable to another person. In addition, once the client has received the booking contract and accepted the terms, any change in travel dates or package details will not be possible.

No rescheduling of packages is possible once the client has accepted the booking contract. Top Inka Travel is not responsible if the client wishes to change the dates of the package, so it is important that the passenger is completely sure of the dates of travel before accepting the contract. In the event that the client wishes to change the dates of the package, the client must proceed with the cancellation of the package (review the cancellation policies) and hire the service again, subject to availability.

At Top Inka Travel, we understand that unforeseen situations may arise (health, personal, labor or force majeure) that may cause the passenger to modify or reschedule their package. However, Top Inka Travel does not accept modifications or rescheduling under any circumstances, regardless of the reasons that generate them. This includes, but is not limited to, health situations, personal problems, labor problems or any event beyond our control (force majeure). Once the package has been booked and the booking contract has been accepted, the dates and services of the package are final.

FORCE MAJEURE CONDITIONS

Top Inka Travel informs that, in case of force majeure, it will not assume responsibility for changes, rescheduling or cancellations of tour packages. Situations such as strikes, social unrest, road blockades, landslides, train delays, extreme weather conditions or governmental decisions that affect the execution of the itinerary are considered force majeure. These unforeseen events may alter the operation of tours to Machu Picchu, trekking circuits or contracted tourist services. In these cases, similar alternatives will be offered subject to availability, but no refunds will be made. Any additional expenses generated by these changes will be covered by the passenger.

Tourist services totally or partially affected by force majeure are not refundable. If the client decides not to accept an alternative proposal, it will be considered as a cancellation by the passenger.

CLIENT RESPONSIBILITIES

In order to guarantee a safe and organized travel experience, the client agrees to comply with a series of essential responsibilities. It is essential to be punctual in each activity of the itinerary and to follow the indications of the assigned guide at all times, both before and during the tour. In addition, the passenger must carry the same official documents (ID card or passport) used at the time of booking throughout the trip, making sure they are valid and up to date.

The client is also responsible for processing his/her tourist visa in case it is required before entering the country. Top Inka Travel does not arrange visas for travelers, so it is important that each client ensures that he/she has the necessary documents to enter Peru and participate in the activities.

The client is also responsible for informing the travel agency of any eventuality or special situation that occurs during the tour (such as accidents, illness, loss of objects or documents), so that Top Inka Travel can offer timely assistance within its possibilities. Likewise, in case of flight delays or rescheduling, it is essential that the passenger notifies the agency immediately, as this will allow us to correctly activate our policies of modifications or rescheduling according to availability and previously stipulated conditions.

TRAVEL, HEALTH, AND/OR LIFE INSURANCE

Top Inka Travel strongly recommends that all passengers purchase travel, health, or life insurance prior to their trip, as our services do not include these types of coverage. It is the passenger’s responsibility to consult their doctor regarding any risks related to trekking activities, altitude, or any other health condition.

In the event of accidents during trekking or tours, such as falls, injuries, or issues related to lack of oxygen, the passenger must inform the guide immediately to receive assistance. All our guides are trained in first aid and are prepared to handle emergency situations. If the situation becomes critical, the passenger will be transported to the nearest medical center. Any medical costs resulting from such incidents will be the responsibility of the passenger or their family.

In the event of a loss of life, Top Inka Travel will notify the relevant authorities and assist with the administrative process if necessary. However, all expenses related to the procedures, repatriation of the body, and documentation will be borne by the passenger or their immediate family.

It is important to note that Top Inka Travel is not responsible for health complications, loss of belongings, or incidents beyond its control during the trip.

THIRD-PARTY SERVICES

At Top Inka Travel, as a travel agency and tour operator, we offer our clients a complete experience by integrating both in-house and third party services. This includes hotels, restaurants, tours, airlines, ground transportation and local guides. All of these services go through a quality evaluation process before being contracted and included in our tour packages, thus guaranteeing that our clients receive the best at every stage of their trip.

However, Top Inka Travel is not responsible for incidents, changes, delays or unforeseen problems that may arise due to the management of these third party providers. Although Top Inka Travel ensures that each service meets high quality standards before being part of our packages, we cannot control unforeseen events that may occur due to services offered by external suppliers, such as airlines, hotels, transportation operators or local guides.

It is important that our clients understand that services provided by third parties are subject to their own policies and conditions. Top Inka Travel acts as an intermediary, but does not guarantee that these services will be free of mishaps. In case of any inconvenience related to these services, the client must deal directly with the corresponding provider.

RISK ACCEPTANCE

By contracting the services of Top Inka Travel, the client accepts the risks inherent to adventure activities such as trekking, high altitude hiking and other tourist experiences. These risks may include accidents, falls, injuries, illness or adverse weather conditions.

The client is responsible for following the safety instructions provided by the guides and must report any discomfort or incident during the trip in order to receive immediate assistance. Top Inka Travel is not responsible for damages or injuries caused by situations beyond its control or for not following the safety recommendations.

By making the reservation, the client acknowledges and accepts the risks associated with the activities offered and understands that their participation is completely voluntary.

AUTHORITY DURING THE TOUR

During the entire tour, the final decision in any situation that compromises the safety and well-being of the group will be made exclusively by the guide or Top Inka Travel representative. It is essential that all passengers follow their instructions, as their main responsibility is to ensure the collective safety of the participants.

Clients must at all times comply with local Peruvian laws and regulations, including customs regulations, foreign currency and restrictions on prohibited substances. Failure to comply with laws or any inappropriate conduct may result in the immediate exclusion of the client from the tour, without refund, in order to preserve the safety and well-being of the group.

Top Inka Travel is committed to guaranteeing a safe and pleasant experience, but the responsibility for following the regulations of the country and the indications of our team rests entirely with the client.

RIGHT TO USE IMAGES

By booking a package with Top Inka Travel, the client grants consent for the agency to use images, photos and videos captured during their participation in the tour for promotional and advertising purposes. This material may be published on our digital platforms, social networks, and other marketing media at no cost.

Top Inka Travel agrees to use these images in an ethical and responsible manner, exclusively for advertising purposes of the agency. By confirming the reservation, the client accepts that his image, video or related content may be used for the promotion of Top Inka Travel, without the need to request additional consent.

CLAIMS AND/OR COMPLAINTS

If you experience any inconvenience or have a complaint during your trip with Top Inka Travel, we ask that you notify your travel agent immediately. The agent will be responsible for communicating the situation to management to seek an appropriate solution, provided you are in Cusco.

In the event that a resolution is not achieved on site, you may request the Complaint Book in physical or virtual format. The virtual Complaints Book is available on our website for easy access from any location. For claims made through the virtual or physical book, we commit to respond within 30 working days.

Top Inka Travel is committed to resolve your concerns quickly and efficiently, ensuring the best possible experience during your trip.

ACCEPTANCE OF TERMS AND CONDITIONS

By making a reservation and/or contracting any of the services offered by Top Inka Travel, the client accepts expressly and without restrictions all the terms and conditions set forth in this document.

The client understands and acknowledges that he/she has read, understood and accepted all cancellation policies, modification, responsibilities, force majeure conditions, and any other provision related to the services of Top Inka Travel. In case of not agreeing with any of the points described in these terms, the client must refrain from making any payment or reservation with the agency.

MODIFICATION OF TERMS AND CONDITIONS

Top Inka Travel reserves the right to modify, update or change at any time the terms and conditions of the services offered. Any modification or update will be valid and applicable from the moment of its publication on our website or any other official means of communication used by the agency.

It is the client’s responsibility to periodically review these terms and conditions before making any reservation or payment, to ensure that he/she is aware of the provisions in force.
